Confusion is Frequent When Staffing Agencies are Involved – covers workers’ compensation law for residents of Lehigh Valley and the state of Pennsylvania. Specifically, it focuses on the difficulties many injured workers face in determining who is legally considered their employer, especially in cases involving individuals who obtain jobs through staffing agencies.

According to Attorney Beichert’s article, Lehigh Valley has grown into a hub for massive distribution centers and warehouses operated by major online retailers, manufacturers, food processing plants, supermarket chains, and other industry giants. Many of these large corporations and facilities utilize the services of staffing agencies to fill positions, as only a small percentage of the workers in these distribution centers and warehouses are actually employed by the company itself.

As a result of securing jobs through the use of staffing agencies, many workers are unsure as to who their actual employer is. Because it is critical to identify the correct employer in matters involving work injuries and workers’ compensation, Attorney Beichert discusses the rights of employees placed through agencies and whether they are covered by workers’ compensation benefits in the event of a work-related injury or illness.

According to Beichert – the answer is that these workers are nearly always covered. In addition to discussing their rights under the Pennsylvania Workers’ Compensation Act and the actions they should take following a work accident, Beichert also delves into the rare circumstances involving workers who are considered independent contractors. He also places an emphasis on the troublesome issues involved in cases where workers are placed by staffing agencies, such as benefit denials, and why it’s critically important for workers to consult with experienced attorneys as soon as possible after an accident.
